Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Cooling-off period
The legally established period during which the consumer has the right to cancel the agreement without providing a reason.
Consumer
A natural person acting for purposes outside their trade, business, or professional activity, entering into a distance agreement with the seller.
Day
A calendar day.
Ongoing agreement
A distance contract that involves the recurring supply of products and/or services over a defined period.
Durable data carrier
Any tool that allows information to be stored in a way that enables future reference and unchanged reproduction.
Right of withdrawal
The legal right of the consumer to terminate a distance agreement within the applicable withdrawal period.
Seller
The natural or legal entity offering products and/or services to consumers through distance selling.
Distance agreement
A contract concluded within an organized system for remote sales, where only distance communication methods are used up to and including the final agreement.
Means of remote communication
Any method that enables a contract to be concluded without both parties being physically present.

Article 3 – Applicability
These Terms and Conditions apply to all offers made by HillaryJane and to every distance agreement concluded between HillaryJane and a consumer.
Before finalizing a purchase, the consumer will have the opportunity to review these Terms. If this is not reasonably possible, HillaryJane will indicate where the Terms can be accessed digitally and will provide them free of charge upon request.
If additional conditions apply to specific products or services, the provision most favorable to the consumer will prevail in case of conflict.
If any provision is deemed invalid or unenforceable, the remaining provisions will remain in full force. The invalid clause will be replaced with a provision that reflects the original intention as closely as possible.
Article 4 – Offers
Offers that are subject to a limited validity period or specific conditions will be clearly indicated.
All offers are non-binding. HillaryJane reserves the right to modify, suspend, or withdraw offers at any time.
Each offer contains a clear and accurate description of the products and/or services. Images are intended to represent the products as closely as possible, although slight variations may occur.
Where applicable, offers will include:
- The total price, excluding VAT and import duties
- Any additional shipping costs
- The method and timing of contract conclusion
- Whether the right of withdrawal applies
- Accepted payment and delivery methods
- The duration of the offer
- Conditions for ongoing agreements
Article 5 – Formation of the Agreement
An agreement is established once the consumer accepts the offer and meets the specified conditions.
If acceptance is made electronically, the consumer may still cancel the agreement until confirmation of acceptance has been provided.
Article 6 – Right of Withdrawal
Consumers may return non-discounted items within 30 days of receipt without providing a reason, provided the products are unused, undamaged, and returned in their original packaging.
Products purchased under Final Sale conditions (items discounted by 40% or more) are not eligible for returns, refunds, or exchanges. This exclusion is clearly communicated prior to purchase.
Article 7 – Costs in Case of Withdrawal
If the right of withdrawal is exercised, the consumer is responsible for the return shipping costs. Returned products must be sent directly to HillaryJane’s international fulfillment partner located in China.
Refunds, including standard outbound shipping costs, will be processed within 14 days after receipt of the returned items or valid proof of shipment.
Article 8 – Exclusions from Withdrawal
The right of withdrawal does not apply to:
- Products excluded for hygiene reasons, such as earrings and lingerie
- Items purchased during Final Sale promotions with discounts of 40% or more
Article 9 – Pricing
Prices stated in offers remain valid for the duration specified, unless adjustments are required due to legal or regulatory changes.
Article 10 – Conformity and Warranty
HillaryJane ensures that products and services comply with the agreement and meet reasonable expectations regarding quality, usability, and reliability.
Article 11 – Delivery and Execution
Orders are processed with appropriate care and attention.
If a delay occurs, the consumer will be informed as soon as reasonably possible.
Article 12 – Payment
Unless agreed otherwise, full payment must be completed at the time the order is placed.
All transactions are subject to these Terms, which define pricing, payment conditions, and delivery arrangements. HillaryJane reserves the right to correct errors in pricing, descriptions, or product availability at any time.

Article 14 – Governing Law
HillaryJane is operated by a company registered in the Netherlands. All agreements between the seller and the consumer are governed by Dutch law.
However, if mandatory consumer protection laws in the consumer’s country of residence provide additional rights, those rights will remain applicable.
Article 15 – Amendments
HillaryJane reserves the right to update or modify these Terms and Conditions. Any changes will be communicated at least 30 days before they take effect.
Article 16 – Shipping and Returns
HillaryJane works with third-party logistics providers based in China. As a result, orders are shipped from China.
Approved returns must also be sent to China. Return instructions and the correct return address will be provided once a return request has been approved.

Return and exchange policies may be updated at any time. HillaryJane retains final discretion regarding the approval of return or exchange requests.
Nothing in these Terms limits or excludes rights granted under applicable consumer protection laws. All statutory rights remain fully valid and may differ depending on the country of residence.
Winter Sale Conditions
The winter promotion remains valid until February 28, 2026. After this date, promotional terms and product availability may be changed or expire automatically.
